In this document, ‘we’, ‘college’ and
‘WIC’ mean Windsor Institute of Commerce Pty Ltd trading
as Queens Academy of Business and Technology Pty Ltd, and/or any
successor organisations. ‘You’ means the student this
application form relates to.
1. VISA: Windsor Institute of Commerce Pty Ltd
is not responsible for your visa. It is your responsibility to arrange
your own visa.
2. ENGLISH REQUIREMENT: International students
must have a good command of written and spoken English. If your
first language is not English and if you can provide satisfactory
evidence that English was the medium of instruction and assessment
in your secondary or tertiary studies, you may be considered as
meeting the College’s requirement of proficiency in English.
However, you may be required to meet the English language proficiency
requirements of DIAC and will need to provide additional evidence
of your English language proficiency when you apply for a student
visa. This usually requires an IELTS score. If English is not your
first language or was not the medium of instruction and assessment
in your secondary or tertiary studies, you are required to demonstrate
your proficiency in the English language by providing certified
or notarised documentary evidence of achieving the college’s
minimum prescribed level of English (IELTS 5.5) or complete an English
language course at an approved institution and provide evidence
that you have satisfied the college’s minimum English language
requirements. This evidence can be no older than two years before
the date of your enrolment at the college.
3. FEES: Course fees are indicative and may be
subject to change without notice. All fees and outstanding payments
must be paid in advance. Certification will not be issued until
all outstanding fees are settled in full. This includes materials
fees and any other fee incurred during your enrolment.
4. MINIMUM AGE: All students must be at least
18 years of age when applying for Windsor Institute of Commerce
Pty Ltd.
5. EXPENSES & OHSC: Your expenses, including
such things as insurance, are not included in the fees we quote.
It is your responsibility to obtain your own insurance, although
if you have a student visa, you can apply for Overseas Student Health
Care (OSHC) on this form. You are strongly advised to obtain your
own insurance even when it is not compulsory for your visa.
6. STUDENT VISA HOLDERS: You must (by law) keep
us up to date with your correct address in Australia, you must maintain
80% attendance over your whole course, and you must make satisfactory
academic progress. You must also have Overseas Student Health Care
for the whole of your stay in Australia on the student visa. If
any dependants (e.g. children) of school age come with you, they
will be required to pay full fees for schools, whether government
or private. It is the responsibility of the student to follow the
rules of their visa, and to find out about any changes to the rules.
7. CANCELLATIONS & REFUNDS If you cancel
your course, we can take no action until we receive the notification
from you in writing.
8. If you cancel your course less than 28 days before your commencement
date, a cancellation fee of 25% of your tuition fees will apply.
No refunds will be made after the start of your course. In the unlikely
event that a student wants to terminate his/her course, the balance
of fees is not refundable.
9. If you cancel your accommodation arrangements, the accommodation
arrangement fee is not refundable. If you cancel your accommodation
more than 28 days before your commencement date, accommodation fees
less the accommodation arrangement fee are refundable. If you cancel
your accommodation arrangements less than 28 days before your commencement
date, accommodation fees are not refundable. No refunds will be
made after the course start date. In the unlikely event that a student
wants to terminate his/her accommodation arrangements after the
arrangement has started, the balance of fees is not refundable.
10. In the unlikely event of default by Windsor Institute of Commerce
Pty Ltd trading as Queens Academy of Business and Technology Pty
Ltd, such situations are covered by the provisions of the ESOS Act
2000 and the ESOS Regulations 2001. In cases where the college defaults,
the college will firstly try to arrange a place for you in an alternative
course at the college’s expense. Failing this, the college’s
tuition assurance scheme, ACPET, will arrange for you to be offered
a place in a suitable alternative course. If a suitable place in
an alternative course is not found after these steps have been taken,
you will get a full refund from the tuition assurance scheme. The

11. If DIAC doesn’t issue a visa for you before the start
date of your course, and we receive from you the letter from DIAC
that says your visa application is rejected, we will refund all
your tuition fees.
12. All fees other than tuition fees and accommodation fees are
not refundable. These non-refundable fees include: enrolment fee,
accommodation arrangement fee and airport pickup fee (except in
cases where Windsor Institute of Commerce Pty Ltd defers or cancels
your course, you can claim a refund of all compulsory fees, including
the enrolment fee).
13. Your tuition fees cannot be transferred to another person
or institution. However, they may be transferred to another course
within Windsor Institute of Commerce Pty Ltd. If you have a student
visa, there may be visa restrictions on courses you can transfer
to, DIAC will be notified and, if a new CoE is required, you must
pay the fee for this (see the college’s fee schedule).
14. All applications for refunds must be made in writing to the
Administration Manager, as soon as possible after the incident which
leads to the refund request.
15. All refunds are made in Australian dollars and will be paid
within two weeks of receiving the written request for refund in
the case that the course doesn’t run, or four weeks of receiving
the written request for refund in all other circumstances.
16. If the refund method involves bank fees (e.g. by bank draft
or electronic transfer), the bank fees will be deducted from the
refund amount. Also, refunds will not include any amount that Windsor
Institute of Commerce Pty Ltd has paid or owes to any organisation
outside Windsor Institute of Commerce Pty Ltd in relation to your
course (e.g. commission to your agent).
17.EXPULSION: Windsor Institute of Commerce Pty
Ltd can expel students and cancel their enrolment for behaviour
which may cause problems for other students, the college’s
reputation, the college’s relationship with other organisations
(such as building management) or for breaking laws applicable in
New South Wales. Appropriate disciplinary procedures will apply.
No refund will be paid to any student who is expelled.
18. Windsor Institute of Commerce Pty Ltd can change its fees,
conditions, course times or course commencement dates at any time
without notice. This could include changing the time of day of your
class.
19. PUBLIC HOLIDAYS: Windsor Institute of Commerce
Pty Ltd is closed on all official New South Wales public holidays
and there is no substitute for public holidays.
20. DAMAGE TO PROPERTY: Incidents that must be
reported to Windsor Institute of Commerce Pty Ltd staff include
damage by students to property at the home stay or at the school,
and any robbery or injury to students within the school premises,
at accommodation arranged by Windsor Institute of Commerce Pty Ltd
or while travelling between Windsor Institute of Commerce Pty Ltd
and any accommodation that Windsor Institute of Commerce Pty Ltd
has arranged. Any damage to college property must be paid for. If
you break any college or building property, you will pay for its
replacement or repair.
21. MARKETING & PROMOTION: Any photographs,
video or sound recording in which you or your voice appear, or written
comments made by you may be used by Windsor Institute of Commerce
Pty Ltd for marketing purposes.
22. FINANCIAL LOSS: The College shall not be
held responsible for financial loss by the students in the event
of any occurrence outside the control of Windsor Institute of Commerce
Pty Ltd, including but not limited to:
• Changes to transport or other services including delays,
suspension, industrial action (including strikes) or schedule changes
• Natural disasters, acts of terrorism, outbreaks of disease
or warnings of outbreak of disease, or war
• Accident or illness involving the student or anyone else
not employed by Windsor Institute of Commerce Pty Ltd
• Breach of immigration regulations or any other law
• Cancellation of the course, accommodation arrangements or
any other service as a result of any of the above
23. PERSONAL INFORMATION: Any information that
you provide us with will be provided to DEEWR, DIAC and other State/Territory
government agencies as well as the Fund Manager of the ESOS Assurance
Fund as required in the ESOS Act 2000 and the Migration Act 1958.
This information includes changes to your enrolment, your attendance
and your academic results. It is a legal requirement that we inform
DIAC (or its successors) if you break student visa rules about attendance
or satisfactory academic performance. We may also give information
(including academic results) to further studies organisations, parents
or guardians (if you are under 18), or your agent.
24. This agreement, and the availability of complaints and appeals
processes, does not remove the right of the student to take further
action under Australia’s consumer protection laws.
25. HOLIDAYS: There are 10 modules of 4 study
weeks in an academic year. The main vacation periods occur in April,
June/July, September/October and December/January. WIC also observes
all Australian and NSW public holidays.
